Lucinda A. Althauser


Lucinda Althauser has a wide range of experience in providing advice and counsel to clients in connection with protecting, developing, acquiring, transferring, and exploiting intellectual property and technology assets. Ms. Althauser prepares and negotiates agreements for the development of software, pharmaceutical products and other healthcare-related technologies, agricultural products, websites, and other technologies. In addition, she has significant experience in licensing patent rights, trade secrets, software, trademarks, copyrights, and other intellectual property rights. She assists clients with acquiring and transferring intellectual property, both in connection with corporate mergers and acquisitions and stand-alone transactions.

Ms. Althauser frequently analyzes and reviews intellectual property assets and rights on behalf of clients and, in that regard, performs patentability and patent validity and infringement analyses, provides advice and counsel regarding the availability of trademarks for use and registration, and analyzes intellectual property portfolios in connection with acquisitions, investments made by venture capitalists, and secured loan transactions. Ms. Althauser’s practice also includes drafting and negotiating sponsored research agreements, collaboration agreements, joint development agreements, employee invention assignment agreements, end-user license agreements, website terms of use, service level agreements, hosting agreements, and reseller agreements.

In addition, as a registered patent attorney with an undergraduate degree in biochemistry, Ms. Althauser prepares and prosecutes patent applications in the fields of computer-implemented methodologies, medical devices, biotechnology, and mechanical devices. She assists client with the management of their intellectual property portfolios, prosecutes and procures U.S. trademark rights, manages foreign patent and trademark prosecution matters, and has represented clients in connection with proceedings before the U.S. Trademark Trial & Appeal Board.
